Terms and Conditions

1. Holiday Tenancy

1.1 This agreement is made on the basis that the house will be occupied by the guest for a holiday for a specified period. It is a contract between Cragg Properties Ltd and the guest/applicant (named on the booking application).
1.2 The guest must be over 21 years of age; will have responsibility for the property and must have the authority to ensure that all members of the party observe the booking conditions.
1.3 By paying your deposit you agree that you are over 21 years of age and that you accept full responsibility for all payments due and for any actions of all persons who will use the property and you will have deemed to have read all the terms and conditions and agree to be bound by them.
1.4 This agreement is for the purpose of a holiday rental only and does not create a relationship of landlord and tenant between you and Cragg Properties Ltd. You will not be entitled to a tenancy or for any other form of statutory security of tenure as a result of this agreement.

2. Reservation

2.1 Please email or telephone our office on 01422 884772 to check availability for the dates you require.
2.2 Cragg Properties Ltd will confirm the booking and accept a provisional booking and reserve the property for your holiday provided we receive a deposit of 30% of the holiday rental fee within 7 working days.
2.3 Once Cragg Properties Ltd has confirmed the dates you require and has received a deposit then an agreement exists between us on these terms and conditions.
2.4 If the holiday is due to start within 8 weeks of the date of booking the total of the holiday rental fee is payable at the time of booking.
2.5 Note your holiday is not confirmed until you have received written or emailed confirmation from us and we reserve the right to refuse any booking before we have issued a written holiday confirmation form.
2.6 As soon as you receive the written or emailed confirmation form you must check it carefully and report any errors to us immediately.

3. Balance payment

3.1 The balance of the holiday rental fee less any deposit will become due 8 weeks before the start of the holiday.
3.2 Cragg Properties Ltd will not send you a reminder but will email a receipt. If you do not have an email address but require a receipt then you need to send us a stamped addressed envelope at the time of booking.
3.3 Over and above the cost of the holiday a £100 refundable damage bond must be paid with the balance of payment.
3.4 Non payment of the final balance will constitute cancellation of the holiday and forfeiture of the deposit payment. As a rule reminder notices will not be issued.

4. Payment methods

4.1 Cheques should be made payable to Cragg Properties Ltd and receipts for payment made will be issued once the payment has been processed, which usually takes 4 working days after the cheques have been banked.
4.2 Electronic bank transfer in to our Alliance and Leicester account in the name of Cragg Properties Ltd, Branch Sort Code: 72-00-02, Account number 81058687.
4.3 Paypal/credit card by asking us to issue a money request via paypal.

5. Damage bond

5.1 The £100 damage bond will be refunded in full by Cragg Properties Ltd within 28 days of the end of the letting period providing the inspection of the property reveals all to be in good order. Should this not be the case the cost of the damages or breakages will be paid for from this bond.
5.2 Any damages incurring costs over and above the £100 damage bond will be invoiced with payment required by return.

6. Cancellation

6.1 All cancellations must be made in writing. Please note that the following terms and charges will apply:
  6.1.1 A full refund of monies paid less an administration fee of £50 if cancellation is made at least 6 months prior to arrival.
  6.1.2 The applicant is liable for 30% of the cost of the holiday or £100, whichever is the minimum, if the holiday is cancelled between 60 days and 6 months prior to arrival.
  6.1.3 The applicant is liable for the full cost of the holiday if cancellation is made 60 days or less prior to arrival.
6.2 If Cragg Properties Ltd is successful in re-letting the property for some or all of the same period they shall return the rent paid for the period which has been re-let less any cost necessary incurred in re-letting the property, e.g. advertising and administration.
6.3 Cragg Properties Ltd does not operate any scheme of cancellation or travel insurance and you should obtain you own insurance cover for the holiday.
6.4 Cragg Properties Ltd reserves the right to cancel the booking at any time in the event of circumstances beyond our reasonable control or if, in our reasonable opinion, it is necessary to undertake essential works to the property. In these unlikely circumstances Cragg Properties Ltd will refund in full all money received by us for the booking. Cragg Properties Ltd will not otherwise be liable for any loss incurred by you as a result of the cancellation.

7. Changes to a booking

7.1 Cragg Properties Ltd will endeavour to assist you in a transfer of a booking to an alternative date at your written request if the property is available. An administration fee of £30 will apply.
7.2 Changes cannot be accepted within 1 month of the start date of the holiday.
7.3 If the change results in the reduction in the length of the holiday it will be regarded as a cancellation.

8. No smoking policy

8.1 Cragg Properties Ltd operate a strict no smoking policy within the house

9. Pets

9.1 We do not allow any pets in the property.

10. Occupancy of the property

10.1 You must not use the property for any purpose other than that of a holiday. Functions, celebrations, ceremonies and parties are not permitted without the written permission of Cragg Properties Ltd.
10.2 The number of people staying at the property must not exceed the maximum number stated in the brochure/website and the use of tents or sleeping in motor vehicles adjacent to the property is not permitted.
10.3 You must not use the property for any activity or in such a way as to cause nuisance or annoyance to neighbours.
10.4 You and your guests must comply with any reasonable regulations relating to the property or the site around the property as listed in the information pack within the property.

11. Arrival and departure

11.1 The holiday rental period begins at 3.00pm on the first day of your booking period and ends at 10.00am on the day of departure. It is important that these times are adhered to so that the accommodation can be properly prepared for you and subsequent guests. Guests will be liable for any extra cost incurred for attempting to stay beyond the departure time.
11.2 All keys are to be returned to the Cragg Properties Ltd as agreed.

12. Property information folder

12.1 An information folder is provided in the property containing important information about the property and local services. If missing, the guest must advise Cragg Properties Ltd immediately.
12.2 The inventory included within the folder should be checked by guests on arrival and any discrepancies reported immediately to Cragg Properties Ltd.

13. Cleaning and linen

13.1 A thorough clean and a change of linen is provided between stays and weekly during holidays.
13.2 If requested at the time of booking a further mid week clean and linen change is available at an extra cost of £60.

14. Your obligations

You agree to:-

14.1 Take good care of the property, maintaining all furniture, fixtures, fittings and effects in the same state of repair as at the commencement of the holiday.
14.2 Use the property and its contents in a safe and appropriate manner.
14.3 Read instruction booklets before use of appliances.
14.4 Keep the property secure and lock (where locks exist) all windows and doors and set the burglar alarm whenever the property is left unoccupied and comply with safety and security precautions.
14.5 Not to use the property or any part of it for any of the following nor allow anyone else to do so:-
  14.5.1 Activities which are dangerous, offensive, obnoxious, noisesome, illegal or immoral which are, or may become, a nuisance or annoyance to Cragg Properties Ltd or occupiers of any neighbouring property.
14.6 Not to act in any way which will or may result in the insurance of the property being void or voidable or in the premium for the insurance being increased nor to allow anyone else to do so.
14.7 Leave the property in the same state of cleanliness or general order in which it was found (an additional cost will otherwise be incurred to cover the extra cleaning).
14.8 Report any damage or breakage immediately to Cragg Properties Ltd.
14.9 Pay the cost arising from any breakages or damage to any furniture of fittings, removal of any item from the property, damage to the exterior of the property including any damage to neighbours property.
14.10 Not to make any noise at the property which is audible from outside between 11.00pm and 7.00am.
14.11 Place refuse, surplace food and unwanted articles in the bin liners inserted in the waste bins provided and if full to dispose of the contents of the bin in the refuse container outside of the house and to replace disposed of bin liners with fresh empty ones.
14.12 Not to drop any litter in the roadways, paths are parking area.
14.13 Not to block the waste pipes and drains.
14.14 Not to tamper with the electric, gas, water or sewerage services, pipes or equipment.
14.15 You must allow anyone authorised by Cragg Properties Ltd to enter the property during the holiday. Cragg Properties Ltd will endeavour to give you reasonable notice of such a visit except in an emergency where immediate access must be allowed.

15. Cragg Properties Ltd right to refuse/terminate

15.1 Cragg Properties Ltd reserves the right to refuse any booking.
15.2 Cragg Properties Ltd reserves the right to terminate this agreement and ask you and your guests to leave immediately if this is deemed necessary by Cragg Properties Ltd as a result of your behaviour or that of your guests or any other material breech by you of the terms of this agreement.

16. Problems or complaints

16.1 In the event of there being any problems or deficiencies with the accommodation or contents the matter should be reported to Cragg Properties Ltd at once. Notification by the guest is required to enable remedial action to be taken.
16.2 No complaints will be accepted or correspondence entered into where complaints are made at the end of the tenancy.

17. Lost property

17.1 Cragg Properties Ltd will not be responsible for loss or damage to any of your belongings.

18. Liability

18.1 Cragg Properties Ltd cannot accept any liability for:
  18.1.1 Any injuries sustained by any person
  18.1.2 Cars which are parked at the owners risk
  18.1.3 Noise, nuisance or disturbance resulting from building works, noisy neighbours or local events, etc.
  18.1.4 Disruption of services from utility suppliers.
  18.1.5 Closure of shops and amenities described in the property details.

19. Breaking the terms and conditions

19.1 Cragg Properties Ltd reserves the right to terminate the tenancy without refund if there is a breech of any of these conditions. This is without prejudice to any of the other rights and remedies available to Cragg Properties Ltd.

20. Non availability of the property

20.1 In the event of the property becoming unavailable (e.g. through fire or other natural disaster) the tenancy is automatically cancelled or ended and Cragg Properties Ltd will refund all monies paid or if the letting has commenced proportionately any part of the rent for any period for which the property cannot be used. In no event shall the liability of Cragg Properties to the guest exceed the rental paid for the property.

21. Data protection

21.1 All personal data provided to Cragg Properties Ltd will be held and processed in accordance with the requirements of the 1998 Data Protection Act. We will keep your personal data safe and secure.
21.2 We will not share it with any organisation without your knowledge and consent unless required by law to do so.
